Would You Sue For A Bad Massage?
Following a recent onslaught of liability claims made against health spas in lots of areas, many are now having to review the way they deal with customers. The number of claims last year increased by 36% according the National Spa Association, the majority of which were related to massage. The situation has led to an increased depth in the spa treatment screening process of clientele and more legal protective procedures to be put in place.
A case last year of a woman suing a local spa after she claimed she was injured by a bad massage, is likely to be the cause of the increase in claim activity. The lady already had previous back problems but told the therapist they would not be an issue.However, when she was left with temporary debilitating pains apparently caused by the treatment, she decided to make a claim and was given over ten grand her troubles.
Since this incident, the amount of claims being filled has gone through the roof. Whilst the majority have been massage related, spas have also seen a rise in claims related to skin damage, emotional trauma and even sexual harassment. It is thought that a large majority of the claims are false and are made by people looking to make some quick compensation money. A number of insurance companies have announced that they will take strong legal action against false claims, but this is still a worrying time for any health spa.
Spas are being urged both by insurance companies and spa governing bodies to not only cover themselves with thorough screening forms and disclaimers, but also make sure their standards are the highest possible. They are advised to source any skin care products from reputable companies, service and check over their equipment as often as possible, and maintain regular high quality treatment training for their therapists
